Overview
We are seeking an experienced immigration litigation lawyer to assist with Federal Court Judicial Review matters arising from Canadian immigration refusals and related immigration decisions.
The successful candidate must be an active member in good standing of a Canadian law society and authorized to represent clients before the Federal Court of Canada. Experience with immigration litigation, Applications for Leave and Judicial Review, refusal analysis, GCMS/CTR review, affidavit preparation, application records, memoranda of argument, settlement discussions, and Federal Court deadlines is strongly preferred.
Responsibilities may include:
- Reviewing immigration refusals and assessing potential grounds for Judicial Review;
- Advising clients on Federal Court options, risks, timelines, and remedies;
- Preparing and filing Applications for Leave and Judicial Review;
- Reviewing Certified Tribunal Records and preparing legal arguments;
- Drafting affidavits, application records, memoranda, and reply materials;
- Communicating with clients, opposing counsel, and the Court as required;
- Attending and arguing Federal Court hearings where leave is granted;
- Working with our office on immigration-related background documents while maintaining independent professional obligations to the client and the Court.
Requirements:
- Active member in good standing with a Canadian law society;
- Experience with Canadian immigration law and Federal Court Judicial Review matters;
- Strong legal drafting, litigation, and client communication skills;
- Ability to manage urgent filing deadlines;
- Professional liability insurance and compliance with all applicable Law Society requirements;
- Familiarity with IRCC, CBSA, IRB, GCMS notes, refusal letters, and immigration procedural fairness issues is an asset.
Compensation:
Compensation structure to be discussed and must comply with all applicable Law Society rules, professional conduct obligations, retainer requirements, and client billing requirements.
