About Our Practice
Creditors’ rights litigation is a specialized area of practice requiring a strong understanding of commercial lending structures, secured transactions, and enforcement strategy. Our lawyers work closely with financial institutions and commercial lenders to enforce rights under credit agreements, security instruments, and guarantees.
This practice is best suited to litigators who are interested in strategic enforcement work and practical asset recovery, rather than general civil or insurance defence litigation.
Key Responsibilities
Act as counsel in creditors’ rights and recovery matters, primarily within Ontario, on behalf of financial institutions and commercial clients.
- Conduct litigation relating to secured and unsecured debt enforcement.
- Appear before the courts to advance clients’ interests.
- Prepare and review pleadings, motion materials, and enforcement documentation.
- Advise clients on litigation and recovery strategies and provide timely updates and practical legal guidance.
- Manage litigation files efficiently from initial review through enforcement and recovery.
- Work collaboratively with colleagues, enforcement professionals, and external agents across Canada.

Our creditors’ rights practice regularly involves the enforcement of defaults relating to:
- Credit cards
- Lines of credit
- Motor vehicle leases and financing
- Loans and promissory notes
- Guarantees
- Chattel mortgages
- Conditional sales contracts

- Commercial and consumer debt
Our lawyers regularly handle enforcement proceedings such as:
- Seizures and repossessions

Qualifications
- Member in good standing with the Law Society of Ontario.
- 2–7 years of experience in creditors’ rights, enforcement, or recovery litigation
- Minimum 3 years of litigation experience
- Willingness to obtain membership in additional Canadian law societies as required to support the firm’s national practice.
- Strong litigation and file-management skills with the ability to manage competing priorities.
- Excellent written and oral advocacy skills.
- Ability to communicate effectively with clients and provide practical legal advice.
- Experience with secured transactions, PPSA enforcement, mortgage enforcement, or judgment recovery is considered a strong asset.
- French language ability is considered an asset.
