Job Description

Lakeland Consulting supports projects from early planning through to completion, helping clients achieve successful outcomes at every stage. The team brings extensive experience and a diverse set of skills in project development, procurement advise, cost control, scheduling, risk and contract management. The company also provides dispute resolution and expert advisory services to all types of clients. Most importantly, the company is actively giving back and supporting the construction industry with knowledge sharing initiatives from its Knowledge & Resolution Hub in Oakville, Ontario where industry leaders come together to share experiences, pass on insights, and collaborate on change.
Due to continued growth and a strong project pipeline, we are seeking multiple Commercial Managers to join our team. These roles span intermediate to senior/leadership levels, supporting major infrastructure, transit, and building (including ICI) projects across Ontario.
This is an opportunity to join a high-performing team delivering commercial management expertise and claims/issue management, support services on complex projects.

Recognizing that construction projects (in all sectors) involve complex contracts (“Contracts”), Commercial management may be broadly defined as the expertise (“Commercial Expertise”) in drafting, reviewing, challenging, and resolving Contracts and the underlying basis of the Contract’s commercial terms relating to: Scope; Schedule; Costs; and Terms and conditions.

While each Capital Project and Client is unique, certain general objectives and specific examples of what a Contract & Commercial Specialist position includes are:

Advising and providing expertise on matters subject to claims and disputes that require intervention in order to progress to the life cycle of resolution, partly supervised;

Providing expert advice on matters of contention (e.g. Litigation, arbitration, alternative dispute resolution etc.) relating to Capital Project Contracts, partly supervised;
-
Providing fairness, independence and rigour to the Client’s process of procurement and assurance, often in order to achieve competitive strain, partly supervised.

Preparing EOI’s, RFQ’s, RFPs, evaluation and contract documentation (encompassing scope, schedule and compensation criteria) during procurement.

Review contract compliance including technical, insurance, regulatory, labour and deliverables
-
Administer contracts postaward: process change orders, amendments, and manage contractual correspondence.

Monitor vendor and subcontractor performance and resolve compliance and billing issues

Set-up project control dashboard to monitor Key Performance Indicators

Perform time and cost impact analysis for specific events during project delivery

Review progress schedules as per project agreement requirements and adopt best practices

Assist in claims avoidance and change control (RCO’s, CO’s, CD) documentation

Liaise with legal and finance teams for contract review and payment coordination

Prepare reports on contractor requests for relief (cost and schedule)

Provide delay claim assessments for clients and analysis reports confirming findings

Provide support to project teams to ensure that contract obligations are adhered to

Deliver contracts and commercial tasks during project formation and delivery
Qualifications
Intermediate Professionals (3+ years):
-
Hands-on experience working on construction contracts, including standard form and bespoke.
-
Hands-on experience working with cross-functional teams, proactively progressing mandates and initiatives.

Knowledge and understanding of contractual mechanisms and administration.
-
Knowledge and understanding of various compensation mechanisms and payment processes.
Senior Professionals (7+ years):
-
Experience leading commercial functions on complex projects.
-
Experience with developing and executing contracting strategies relating to contracts, and negotiations.
-
Experience with various compensation mechanisms and payment processes.
-
Experience in issue management, claims, or dispute support is desirable.
-
Ability to support in the management of client mandates and to provide commercial management advisory to clients throughout the delivery of services.
