Target Compensation: $32.11 per hour.
Regular Work Hours: FULL TIME WORK HOURS – 7.25 work hours per day, not including unpaid 45 min lunch break, to be worked during regular business hours, Monday to Friday (36.25 work hours per week).
Work Location: 100% onsite at Client's Downtown Toronto office, near TTC station.
Position Reports To: Assistant Manager.
Responsibilities Summary:
To provide legal assistance to civil litigation team, working under direction of various legal counsel and independently as appropriate, while also performing administrative duties as required. Will be assigned to one or more civil litigation practice areas (Personal Injury, Carriage of Motions for Third-Party Records, Indigenous Litigation, Class Actions, Corporate Commercial Litigation, Public Law Litigation).
- Gather, assess and catalogue evidence (files, records, medical, technical or physical objects) obtained during meetings or consultation with clients, experts and others or as productions or disclosures in legal proceedings.
- Review records and evidence, including historical and highly sensitive documents, to assist counsel in determining liability and quantum of damages.
- Receive instructions and files from clients, determining pertinent information and case history, informing counsel of relevant details, setting up bring-forward systems and preparing necessary documents. monitor files and ensure compliance with limitation periods, Rules of Civil Procedure, legislation, case management rules and alternate dispute resolution requirements.
- Communicate with clients and witnesses regularly and conduct witness interviews, including making recommendations as to the identity and suitability of witnesses and ensuring witnesses and documents are available.
- Draft pleadings and other legal documents, such as Notices of Motion, Lists of Documents, Affidavits, records, facta.
- Ensure compliance with limitation period and time limits imposed by the Rules of Civil Procedure, legislation, case management rules and alternate dispute resolution requirements.
- Assist counsel in preparing for examinations for discovery, motions, pre-trials and trials, public inquests or inquiries, and attend at same to assist counsel.
- Conduct searches (title and property, corporate, bankruptcy) and research legislation, regulations, law reports, and publications, utilizing computerized legal databases such as Quicklaw, WestLaw, and Law Trac.
- Undertake projects or assignments, such as drafting government business contracts for tenders for consultants and carrying out investigations, managing large document files, preparing transcript commentaries and chronological lists or summaries of documents.
- Identify the implications of claims and submit recommendations to counsel.
- Docket time according to office guidelines using case management software.
- Prepare bills of account as required.
- Additional legal and administrative responsibilities as required.
Qualifications:
Education: Diploma in Law Clerk studies or related legal field, or applicable combination of work experience and education.
Preferred Work Experience: At least 2+ years of progressive, related work experience in civil litigation.
Preferred Sector Experience: Litigation law experience required.
Technical and Language Skills Requirements:
- Proficiency in MS Office 365 including Word and Excel (will be tested).
- Minimum typing speed of 50 WPM (will be tested).
- Ability to work with PDF software such as Adobe Acrobat (may be tested)
- Proficiency with case management/data management systems.
- Experience researching computerized legal databases such as Quicklaw, WestLaw and Law Trac.
- Proficient English communication skills, both written and verbal, including strong business and legal drafting skills, excellent spelling, grammar, proofreading and syntax, and polished, professional telephone manners.

- Strong knowledge of the Ontario Rules of Civil Procedure and applicable legislation, case management rules and alternate dispute resolution requirements.
- Superior attention to detail, and organized, methodical approach to completion of tasks.

- Proven ability to professionally handle confidential and highly sensitive information and exercise good judgement in the interpretation and application of instructions and organization policy.
- Advanced organizational, coordinative and time management skills, with the ability to prioritize work effectively, meet tight deadlines and work well under pressure.
- Demonstrated ability to work well independently and collaboratively, and liaise effectively with counsel, internal teams and limited external stakeholders.

- Must be legally entitled to work in Canada, providing satisfactory documentation upon request.
- Ability to work 100% onsite, abiding by organization health and safety policies.
- Ability to promptly provide minimum of 2 reasonably recent, qualified employment references upon request who are available to speak with either Marberg or Marberg's client.
- Ability to declare personal Non-Conflict of Interest in execution of assignment responsibilities prior to assignment start.
- Provision of certification of AODA and OHSA online training course completion prior to assignment start.
- Satisfactory Background Checks, Technical Skills Evaluations, and Employment References as required.
