The Litigation Law Clerk supports counsel in all stages of plaintiff-side personal injury litigation, from intake through trial and appeal. The role requires strong knowledge of Ontario civil procedure, accident benefits litigation, and court filing systems, with the ability to manage complex files independently under lawyer supervision.
Key Responsibilities1. Litigation & Court Procedure
- Draft and prepare litigation documents including:
- Statements of Claim, Defence, Reply
- Affidavits, Motion Records, Factums
- Trial management documents
- Costs Outlines and Bills of Costs
- Manage deadlines under the Rules of Civil Procedure
- Coordinate motions, pre-trials, mediations, and trials
- File documents electronically through Justice Services Online (JSO)
- Arrange service and filing in Superior Court of Justice
- Prepare and organize trial briefs, exhibit books, and witness lists
- Personal Injury–Specific Duties
- Manage motor vehicle accident (MVA) litigation files
- Coordinate medical, expert, and vocational evidence
- Request, review, and organize:
- OHIP and MSP records
- Hospital, family physician, and specialist records
- Section 42 and insurer examinations
- Maintain medical chronologies and document summaries
- Assist with quantum analysis and damage briefs
- Track limitation periods under the Limitations Act, 2002
