Commercial Litigation and E-Discovery Law Clerk- $120K-$140K

Law Clerk Role and Responsibilities:

Commercial Litigation

Prepare an arraignment of litigation documents, including statements of claim, statements of defence, replies, requests to admit, affidavits of documents, notices of examination, briefs, and orders.

Deep familiarity with the Rules of Civil Procedure (Ontario), particularly regarding service, filing, and deadlines for court documents.

Attend Examinations for discovery or cross-examinations with counsel and take relevant notes.

Review transcripts, request and fulfill undertakings, under advisements, and refusals by liaising with clients.

Manage and track multi-billion-dollar litigation, which includes arranging weekly team meetings and delegating relevant tasks, issuing statements of claim, tracking counsel information and every step within litigation

Prepare, manage, and track Freedom of Information requests

Prepare motion materials relating to summary judgment, noting in default, and substitution of service.

Prepare all documentation relating to arbitrations and trials, as requested.

Review factums and provide comments and feedback.

Conducting legal research on statutes and case law to support litigation strategies. Prepare citations and relevant schedules.

Prepare appeal materials, which included appeal books, exhibit books, factums, and books of authority, including relevant caselaw, hyperlinking, and highlighting.

Prepare bills of cost and cost outlines; Prepare compendiums.

Prepare documentation relating to all aspects of enforcement including questions for JD examinations, notices of garnishment, and writs of seizure and sale.

Prepare documentation relating to Small Claims Court matters, as directed.

Review notices of profession and understand corporate records, to manage strict court deadlines

Bankruptcy, Insolvency and Restructuring

Correspond with counsel, opposing counsel, clients, court staff, service lists, and the Commercial List Office.

Prepare commercial list request forms and model orders.

Prepare checklists and action plans.

Obtain appropriate documentation for application records relating to the appointment of a receiver or monitor, and other relevant matters and various motion records.

Prepare extensive fee affidavits, including relevant exhibits concerning having fees approved by the Commercial List Court.

Review relevant documentation and provide comments on draft Notices of motion, affidavits, orders, plans of compromise and arrangement, and documentation relating to the sale and investment solicitation process (SISP), amongst other requested documentation.

Obtain and review corporate profile reports, Bank Act searches, Bankruptcy and Insolvency Act searches, and Personal Property Securities Act (PPSA) searches.

Prepare summaries relating to the review of PPSAs and prepare registrations and renewals relating to PPSAs.

Prepare Proof of Claim forms and relevant supporting documentation.

Review supporting documentation relating to Proof of Claim forms, summarized same, and prepare relevant Excel spreadsheet for tracking purposes.

Prepare and review relevant appeal materials, which included the appeal book, exhibit book, book of authorities, compendiums, factums, and relevant certificates.

Maintain relevant case bundles within the Case Centre in accordance with relevant Notices to Profession.

e-Discovery

Coordinate with third-party providers to clear conflicts and arranged for document collection from various individuals.

Review documentation provided by the client and coordinated with counsel, and coding panel for review.

Handling document production, maintaining client files, organizing large volumes of evidence, and using e-Discovery platforms like Relativity, DISCO to review electronic evidence. Prepare e-Discovery plan.

Conduct relevant searches for counsel to narrow down search results or locate specific documents.

Prepare affidavit of documents, which included redacting confidential information.

QUALIFICATIONS

• Law Clerk Diploma or post-secondary education degree or diploma in a related field is considered an asset.

• At least 5-8+ years of experience as a Law Clerk in Construction and Commercial Litigation

• Strong attention to detail and technical skills, with the ability to work on large complex agreements.

• Ability to communicate in a professional, efficient manner with clients and external contacts as well as internally throughout the firm.

• Highly organized team player with the ability to work under pressure, deal with changing priorities and meet strict deadlines (this may include being flexible on work hours on an exception basis).

• Excellent proficiency with MS Office Suite, Outlook, iManage, PowerPoint, Excel, Soluno and e-discovery platforms.

• Ability to handle more than one professional and to undertake additional responsibilities as required within the team.
